Lemon Laws and Cars
The Hawaii Department of Commerce & Consumer Affairs reports that in 2007, there were 66 certified cases of Lemon cars. This may seem like a very small number compared to how many new cars enter Hawaii's roads each year; however, many Lemons go unreported because people do not realize that they have rights under Hawaii's consumer laws.
In Hawaii, the Lemon Law aims to assist consumers who have purchased or leased a new vehicle (or a used vehicle that is still under the manufacturer's warranty) that has manufacturing problems or defects which the consumer has difficulty repairing under the car's stated warranty. Many consumers are unaware that if the manufacturer or authorized dealer is unable to properly repair the defective car, they are entitled to a new replacement vehicle, or a refund of the purchase price (usually with a deduction for the mileage the car was actually used).
If you have purchased or leased a car that is still under warranty, and you are having problems with it, please read more about the specifics of Hawaii's Lemon Law.
Automobile Fraud
Unfortunately, automobile fraud is far more common than many consumers realize. Auto fraud occurs in many different situations. Most often, it occurs when a dealership adds unnecessary fees, charges, add-on products, higher interest rates or other items which take money from the consumer, or sells a car with registration or title problems, or tells the consumer a car is new when it is really used, has been in an accident, or had extensive repairs done.
Often, dealerships quote a price for a lease or loan that is too high and is packed with all kinds of features that the consumer may not want and is being overcharged for. You may not even realize that you could have purchased your car, without the features you did not want, for a much lower price. Another problem that frequently occurs in Hawaii is that dealerships take advantage of military personnel's vulnerability, and try to stick them with "problem cars" which will often leave the state when the active duty service member is transferred. Please feel free to read this page to learn more about automobile fraud and how Mr. Crabtree can help you.
Personal Injury and Wrongful Death
The Law Offices of Jeff Crabtree has extensive experience representing plaintiffs in cases involving a wide variety of serious injuries such as brain trauma, spinal cord injuries, fractures, amputated limbs, and wrongful death cases in Honolulu. If you or a loved one has been seriously injured or killed in an automobile, truck, motorcycle, bus, or construction accident; from nursing home neglect or abuse; from a defective product; or burned in a fire or explosion, you may be entitled to recover for the damages you have suffered. There are Hawaii laws in place to protect victims and their families in these situations, so that the person or company responsible is held accountable.
Medical and Professional Malpractice
Medical Malpractice
Medical malpractice is more common than people might think. Some estimates suggest that nearly 200,000 deaths occur each year in the United States that are at least partly due to some form of medical malpractice. Common examples of medical malpractice include misdiagnosis, mistakes during surgery or other procedures, leaving a foreign object inside the patient after surgery, or administering the incorrect type or amount of medication. Only a small percentage of victims and their families ever seek recovery for the sometimes catastrophic damages they suffer because of the malpractice.
Medical malpractice cases can be complex, and suing a doctor or hospital might seem intimidating or emotionally taxing, especially if the injuries are severe or if a loved one dies. This is why consulting with an experienced attorney is helpful.
Mr. Crabtree has extensive experience successfully litigating medical malpractice cases and makes sure he understands the laws as well as the underlying medical issues involved in many types of medical malpractice cases.
Legal Malpractice
Attorneys have many legal and ethical duties to their clients. Lawyers can breach these duties in many ways, such as mishandling clients' money, not representing their client to the best of their ability, and representing multiple clients that have conflicting interests. Clients can also have serious disagreements with their attorneys regarding the fee arrangement or an unreasonable bill. While some attorneys are reluctant to sue other attorneys, Mr. Crabtree has experience in this area and will accept legal malpractice cases if they have merit.
Realtor Malpractice
Purchasing a home is often the most expensive investment people make, and most people use a realtor to help with this process. Sometimes, real estate agents fail to disclose important information about the home, or neighborhood or other homes in the area that would help buyers make better decisions. An attorney with the experience and understanding of these issues can help ensure that you have the best chance of recovering if you feel that your realtor has been dishonest. If you feel you have been the victim of fraud or deceit by your realtor, contact Mr. Crabtree for a free evaluation of your case and to assess your legal options.
