Honolulu Car Accident Lawsuit

Types of automobile accident lawsuits

Most Honolulu auto accident lawsuits involve two vehicles and revolve around the driver or passenger in one car claiming that the negligence of the driver of the other car caused the accident. Of course, there are also cases involving pedestrians, or bicyclists.

Occasionally, however, an auto accident lawsuit in Honolulu is brought against a government agency that may have failed to design or maintain a section of road. An automobile accident lawsuit in Honolulu may also involve a question of product liability. In such a case, the claim is brought against the manufacturer of a vehicle, or vehicle part, involved in an accident and the plaintiff claims that a design or defect in the vehicle itself led to the accident. Such claims may also be brought against a mechanic or service center whose work may have rendered a vehicle unsafe.

Also, if a drunk driver caused the accident, you may be able to make a claim against the bar or restaurant who over-served the driver.

Other issues

Certain issues may arise regarding automobile litigation that can complicate proceedings dramatically.

  • Hit-and-run: When the driver at fault fails to stop at, or flees, the accident scene, the victim may have difficulty bringing suit. That is when it is important to have your own insurance, known as UM/UIM or uninsured or underinsured motorist coverage. This coverage steps in and provides the coverage the other driver should have had.
  • Car-pedestrian accidents: Pedestrians often have difficulty litigating against drivers; as such accidents are often attributed to the pedestrian. With careful investigation and preparation, a solid case can be built that a reasonably careful automobile driver should have seen the pedestrian and stopped in time.
  • Car-motorcycle accidents: Many feel juries are predisposed to find motorcyclists at fault for accidents, even when the driver of the car is clearly the guilty party. It is important to immediately preserve all available evidence establishing who is at fault.
